General Terms and Conditions
1. Introduction
To ensure that you receive the freshest dahlia tubers, flower bulbs and related products, we ship your order when the tubers or bulbs are ready for planting. It is then important to plant your products as soon as possible after receipt or to store them in the right way.
The Flower Farmers guarantees that all tubers and bulbs supplied are true to name, healthy and vigorous, so that you can count on optimal growth and flowering with correct planting and aftercare.
These General Terms and Conditions apply to all agreements and deliveries of The Flower Farmers.

2. Shipping Policy

Time of sending
Your order will be shipped as soon as the tubers and bulbs are suitable for planting. This may mean that your order (depending on the season) will not be shipped the next day. -
Delivery time
We strive to deliver the products within the indicated periods, but are dependent on natural and seasonal influences. Any delays will always be communicated as soon as possible.
3. What if my shipment arrives damaged?
The chance that your shipment arrives damaged is very small. If there is a problem with the delivery, please contact The Flower Farmers customer service within 2 days of receipt via info @theflowerfarmers .nl .

Proof of damage
Save and photograph the damaged package and its contents. We may ask you to send us these photos or to keep the package (including the damaged tubers/bulbs) for at least 14 days so that we can assess the damage. -
Handling
Once we receive your notification, we will file a claim with the carrier, if necessary. We will send a replacement product after the damage claim is approved and the damaged product (if requested) is returned or assessed. -
Out of stock
If the product is out of stock, we will offer you a replacement or full refund. You can also choose to wait until the next shipping season. -
Notification period
Unfortunately, we cannot process claims submitted later than 2 days after receipt of the damaged product. After this period, the customer is deemed to have approved the delivered products.
4. Changes to an order

How to pass on
Please send an email with your change request to info@theflowerfarmers.nl within 60 days of placing your order. -
Exception
For logistical reasons, we are unable to make changes to an order less than 12 days before your package is scheduled to ship from our warehouse (or at the time the products are actually prepared for shipping).
5. Right of withdrawal
You have the right to cancel this contract within 14 days without giving any reason throughout Europe. The cancellation period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the product.

Notification
To exercise your right of withdrawal, you must inform us of your wish to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or e-mail). You may use the model withdrawal form provided by us, but this is not obligatory. -
Term
To meet the cancellation deadline, it is sufficient for you to send your communication before the cancellation period has expired. -
Exception for fresh/perishable products
Flower bulbs, tubers and other fresh produce may fall under the legal exception to the right of withdrawal if these products can spoil, age or become unsaleable quickly after opening the packaging or exposure to unsuitable conditions.- This means that in some cases we may refuse returns of these products once the packaging has been opened or when the products have been handled in such a way that their quality has been affected.
- Do you suspect a production error or damage to the bulbs/tubers upon receipt? Please contact us within the period stated in these conditions, so that we can search for a suitable solution together.
6. Returns (if the right of withdrawal does apply)

Return
If you revoke the contract and the products do not fall under the aforementioned exception, you must send back or hand over the goods to us without undue delay and in any event not later than 14 days from the day on which you communicate your decision to revoke. The deadline is met if you send back the goods before the period of 14 days has expired. -
Costs
The direct costs of returning the goods will be borne by you, unless otherwise agreed. -
Packaging
If possible, please return the goods in the original packaging so that the products are well protected during transport. -
Liability
You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
7. Refunds

Term
We will refund all payments received (including any delivery costs for the outward shipment) within 14 days of the day on which we are informed of your decision to cancel this contract. -
Means of payment
We will use the same payment method as you used for the original transaction, unless otherwise agreed with you. You will not incur any fees for such a refund. -
Condition
We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.
8. Liability

Limit
Our liability is in all cases limited to the purchase price of the ordered flower bulbs, tubers or other products, unless there is intent or gross negligence. -
Usage
In case of incorrect use or incorrect storage or planting conditions, we cannot guarantee growth and flowering. -
Recognition
By purchasing from The Flower Farmers you acknowledge and accept this policy.
